7.1. Example challenges

Challenges 1/2

  1. difference between the legal world and cloud world
is the legal framework suited to govern the cloud reality?
    NO, many traps
  2. identifying obligations
is it easy to find out what are the legal obligations when running a system in a cloud?
NO, the service providers in most cases offer only technical assistance
  3. signing a good contract
are good contracts and good practices available?
NO, the service providers tend to provide the contracts similar to software licenses - no warranty
  4. runtime legal risks
if you are careful, can you sleep well?
NO, e.g. a country X may change the legal rules, your data might be in country X

Challenges - incompatibility 2/2

Concepts for paper documents versus cloud reality

The legal world concepts correspond to paper documents. The cloud systems designed for the things to work and not to reflect the 19th century reality.

Legal world basic notions for data processing

  1. the place of storing data
DHT based storage: you know the logical address of data and not the physical one! For legal systems the physical place counts
  2. the party holding data
who holds data if a cloud consists of many subsystems run by different parties?
  3. original data
a general headache for digital data: what is the original, what is the most recent copy? E.g. complicated quorum systems handle it ...
